Abstract:
The first chapter reviews the conventional principles for determining maritime
boundaries. The first section discusses the principles of determining maritime
boundaries according to the 1982 United Nations Convention on the Law of the Sea
(UNCLOS), which relies on more precise criteria than its predecessors, focusing on
defining maritime zones under the sovereignty and jurisdiction of coastal states,
including internal waters, archipelagic waters, the territorial sea, the exclusive
economic zone, and the continental shelf. It also covers areas beyond the jurisdiction
of coastal states, such as the high seas and the international seabed area, explaining
the legal nature of these areas where the sovereignty of coastal states diminishes as
they move further out to sea. The second section outlines specific agreements for
determining maritime boundaries through various agreements where states have
agreed on principles governing their demarcation, the role of conciliation in
determining maritime boundaries, and agreements related to straits and waterways,
as the UNCLOS does not prevent states from reaching bilateral agreements on their
maritime boundaries.
