The Build-Operate-Transfer (BOT) contract is one of the most important contracts in the
field of sustainable development through public-private partnerships outside the state budget.
Given the importance of this contract, the researcher, within a descriptive and analytical
framework, raises an issue related to the extent of the availability of appropriate legal regulation
for this contract and the impact of this regulation on practical reality through a set of objectives,
the most important of which are: A statement of the legal adaptation of the B.O.T contract and
an analysis of the legal and practical framework governing it, represented by a set of provisions
issued on the most prominent issues that have raised problems with this contract (the case of the
Kuwaiti company Khurafi with the Libyan state). This study concluded with a set of results, the
most important of which are as follows:
1.The Libyan legislator, through the Administrative Contracts Regulation No. 563 of 2007,
explicitly emphasized the generality of the B.O.T contract through the text of Article (137).
2.The negative impact of international arbitration cases in terms of draining Libyan state funds
in the context of investor demands to lift the freeze on Libya's assets and funds abroad
