In arbitration proceedings the resulting decision of the award is delivered in the last
stages of the proceedings. Truly, most contracting parties tend to comply with the concluding
arbitral awards. However, not all international arbitral awards are being voluntarily complied
with. There are proceedings and rules such as The New York Convention and the
UNCITRAL Model Law) attached to arbitrations which render the arbitral awards ‘binding’.
In practice, the recognition and enforcement of awards seem to be straightforward and quick.
There are situations where the arbitrations may act imperfectly and one of the parties may get
affected. In this case, the aggrieved party may wish to challenge the award in order to set it
aside. The setting aside rules of international arbitral awards seem to face a number of
considerable difficulties which result in succeeding few applications of confirming the
annulment of the arbitral award.
